1. Agreement to Terms

By accessing or using LeadGen AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User") and PerWord Local SEO ("Company", "we", "us").

2. Description of Service

LeadGen AI is an AI-powered local business lead generation platform that queries the Google Maps Places API to retrieve publicly available business information (names, phone numbers, addresses, websites, ratings) based on user-specified search criteria (business category and city).

The Service provides lead credits that allow users to perform searches. Credits are purchased through our platform using Razorpay.

3. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Credits and Payments

• Credits are purchased in packages. Each package provides a set number of lead credits.
• Each search consumes credits equal to the number of leads returned (up to 50 per search).
• Credits are non-transferable and cannot be exchanged for cash.
• All prices are displayed in Indian Rupees (INR). Payments are processed by Razorpay.
• Credits are valid for 12 months from the date of purchase.
• We reserve the right to change pricing at any time, but changes will not affect credits already purchased.

5. Acceptable Use

You agree to use LeadGen AI only for lawful purposes. You must NOT:

• Use the Service to send unsolicited bulk email (spam) or engage in any form of aggressive unsolicited marketing
• Scrape, resell, or redistribute the lead data obtained through the Service without authorization
• Use the Service in any way that violates applicable laws, including India's Information Technology Act, 2000 or GDPR
• Attempt to reverse-engineer, hack, or disrupt the Service
• Create multiple accounts to circumvent credit limits or trial policies
• Use automated bots or scripts to perform searches beyond what the platform's interface allows

6. Data Accuracy Disclaimer

All business data is sourced from the Google Places API and reflects publicly available information on Google Maps. We do not independently verify the accuracy of phone numbers, addresses, websites, or other business details.

We are not responsible for inaccurate, outdated, or incomplete business information. Users are advised to verify contact information before initiating outreach.

7. Limitation of Liability

To the maximum extent permitted by applicable law, LeadGen AI and PerWord Local SEO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from:

• Your use or inability to use the Service
• Any inaccurate or incomplete lead data
• Unauthorized access to or alteration of your data
• Any third-party conduct or content

Our total liability to you shall not exceed the amount you paid for credits in the 3 months preceding the claim.

8. Intellectual Property

The LeadGen AI platform, including its design, code, and content (excluding lead data from Google Maps), is the intellectual property of PerWord Local SEO. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Service Availability

We strive to maintain 99% uptime but do not guarantee uninterrupted access. We may suspend or terminate the Service at any time for maintenance, security, or other reasons. In the event of extended downtime, we will make reasonable efforts to notify users and provide credit compensation.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time if you violate these Terms. Upon termination, your right to use the Service and any remaining credits will be forfeited without refund.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India.

12. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after modifications constitutes your acceptance of the updated Terms. We will update the "Last updated" date at the top of this page when changes are made.
